The reasons for the lawsuit, according to Mikolaj Orzechowski, who published the text in Bankier, depend on whether CD Projekt RED violates Article 286 of the Polish Penal Code. In short, this is a "misleading presentation for financial gain", which refers to the poor performance of the game on Xbox One and PlayStation 4.

Recall that over the weekend CD Projekt RED released patch 1.05 for Cyberpunk 2077, in a constant effort to fix the game, while Microsoft reports a warning in its digital store for title players on Xbox One. CD Project Red is also scheduled to release a series of updates to the title, next January and February.

Meanwhile, late last week, there were reports that CD Projekt RED was also facing "internal hostility" from its staff over game management issues and unrealistic expectations from senior executives, leading to a failed release of Cyberpunk 2077 on the platforms of the previous generation.

Cyberpunk 2077 will be available for Xbox One, PlayStation 4 and PC from December 10, while its versions for Xbox Series X / S and PlayStation 5 will be available sometime in the future.
